Court reserves decision on petition seeking FIR over PIMS tragedy

“The District and Sessions Court Islamabad on Thursday reserved its decision on a petition seeking registration of a First Information Report (FIR) in connection with the PIMS incident. Sessions Judge R…”
Sessions Judge Raja Asif heard the petition filed by lawyer Riaz Hanif Rahi. During the proceedings, police urged the court to dismiss the plea seeking registration of a case. Rahi argued that the PIMS incident was known to the public and had resulted in the loss of precious lives.
He questioned the legal basis for the inquiry committee formed by the prime minister, arguing that an inquiry committee could not have legal standing without approval from the federal cabinet. The petitioner’s counsel further claimed that compensation of Rs5 million had been fixed as blood money for the deceased children, while a nurse had allegedly been awarded Rs10 million.
He argued that the police were acting in accordance with government policy rather than the law. During the hearing, Judge Raja Asif asked whether a similar petition had been filed before any other court.

Rahi clarified that no other petition seeking registration of an FIR had been filed, although five writ petitions had been submitted regarding action related to the incident. The judge directed the lawyer to provide the numbers of all five petitions and said he would issue an order on the FIR petition after reviewing the details.
After hearing arguments from both sides, the court reserved its decision on the petition seeking registration of a case over the PIMS incident.
